Definitions

Garbology LLC is also known as “Garbology,” “the company,” “us” or “we.”

“Organics” is also known as “compost” or “compostables” and refers to biodegradable waste designated to be sent to a composting facility. It includes both food scraps and organic plant matter from yards.

“Customer” is somebody that contracts Garbology for waste, recycling, organics or bulk item pickup.

Collection

Containers must be set on the pavement by 6:00 am on service day. Containers must be on the pavement/asphalt (not sidewalk or driveway) for service. We may return emptied containers to the sidewalk or driveway to ensure neighborhood cleanliness, but this does not change setout location.

The permissible materials in the container may change based on the requirements of our partner processing facilities. Please refer to garbology303.com/faqs to follow the latest guidelines. Any container with a contaminant may be emptied entirely as trash at the Garbology driver’s discretion in order to ensure clean end product (quality compost or recyclables).

If any container weighs more than 150lbs gross weight it may be left behind without a refund. Customer agrees to receive text notifications of such service issues.

Garbology makes no promise as to the time of day we will service our customers. Various factors affect operations and may cause a delay. If a container cannot be collected we may text the customer. Customers opt-in to text communications when they sign up for service with Garbology - message and data rates may apply.

We will text customers if their containers are not out. On the first two occasions, if we receive a reply to this text within 5 minutes indicating the customer is setting the container out, we will return at no cost. On no more than two separate occasions for each customer will we return for free. On the third occasion of container not being out by 6:00 am, customer acknowledges that a $25 extra charge will be applied on their next bill in order for us to return and service container.

Service occurs weekly May 1st through September 30th; the rest of the year a calendar is used to indicate our fortnightly schedule for compost/recyclables collection.

Customers are allotted one container ("cart") for organics and acknowledge that anything set out next to this cart is considered waste and may be collected at cost. Extra costs begin at a rate of $5 per item  beyond the provided cart.

In Jefferson County Only:

Garbology doesn't distinguish between container sizes. Customers may use their own container provided it is under 150lbs gross weight on collection day and meets ANSI Z245.60 standards for Type B containers.

Pricing doesn't vary based on the size of container, as container styles vary and some customers use their own containers.

Communication

All customers must have a cell phone number active during their service. By signing up with Garbology, a customer agrees to opt-in to text message notifications from the company. Message and data rates may apply.

Garbology uses texting to update customers on billing issues, service issues (ex: container not out, reminders to set out containers the night before service), service delays (ex: weather, holidays), and other unforeseen circumstances.

Communication may also happen through text in order to schedule bulk item pickups, container delivery at start of service, or container removal at end of service.

Customers may cancel service at any time as long as a contract is not in place. Customers are asked to do so via text.

Billing

All sales are final.

All payments are made in advance of regular recurring service.

Customers are billed either once a month, once every 3 months, or once every 12 months depending on how they signed up.

Customers’ payment method will be charged automatically every 30, 90, or 365 days depending on how they initially signed up for service with the company. Recurring charges may occur without prior notice from the company.

Customers’ payment method must remain active during service. Please contact Garbology to update it and avoid service interruptions.

A customer may cancel anytime provided no contract is in place. Customers must contact Garbology in order to cancel. If a customer cancels before the allotted service period for which they paid, Garbology will make an effort to refund the customer for any unused service, but does not guarantee refunds once customers cancel.

Bulk item pickups are charged on a one-time basis in advance of pickup.

If Garbology is unable to collect bulk items, garbage, recycling, or organic waste for any reason, we will make every effort to collect the item(s) at the next scheduled day in addition to one week's worth of waste at no additional charge, however we will not refund customers for the missed service.

Customers agree to pay retroactively for extras that do not fit in the provided Garbology container, ex: Kate pays for service monthly. An extra item she set out in March will be charged on her April bill. If Kate then sets out waste beyond what fits in her container on April 15th and cancels service on April 30th, in May she will still be charged for that extra item she placed outside the container.

If a customer cancels service, Garbology will use texting as the primary method to contact the customer and arrange for final pickup of waste, recycling, or organics along with the containers loaned to the customer for the duration of service. If containers are not on the pavement at the arranged time, customer agrees to pay a fee of $75 per each container Garbology is unable to retrieve.

Bulk Item Pickup

Customers are asked to send pictures of bulk items they want collected along with an inventory (list) detailing quantity and type of item. Therefore, customers agree to receive texts from the company to provide a quote of removal fee and arrange this one-time service. Message and data rates apply.

Customers agree to pay a non-refundable $0.50 deposit as an initial means for Garbology to acquire payment method information. Once a picture is sent to garbology via text along with an inventory of items, we will provide customer with a quote on our removal fee. Once the customer agrees to use Garbology for bulk pickup of said items in picture(s) and inventory, the same payment method will be charged for pickup and then Garbology will collect those items (usually within 1 week of payment).

Items must be placed within six feet of the street for collection. Garbology assumes no responsibility for damage to customer's driveway.

Additional charges may be incurred if items were not included in the initial photo/inventory. Customer agrees to pay these charges, however we will make every effort to communicate before charging more than the quoted removal fee.

Damage


Garbology assumes no liability for damage to driveways, sidewalks, curbs, or overhanging branches we may cause during collection or driving activities.

Customers are asked not to assist with loading of bulk items or any other waste or recyclables that garbology is hired to collect.

Garbology assumes no liability for injury of customers that may happen during waste, recycling, compost or bulk item collection. Customers are hereby asked to stand clear of equipment during that collection process.

Property Rights

All waste, recycling, and organics is the property of Garbology once it is placed at the street in or near our container (local jurisdictions’ laws supersede this point, where applicable).

It is hereby agreed that items within 4 feet of our container on collection day will be considered waste at the Garbology driver's discretion. Please avoid storing items near or on top of our container on collection day once the container is on the pavement.

We are not responsible for lost items. Garbology will not retrieve anything from our truck once the container is emptied, ex: for customers who may have accidentally thrown something out.

Rolloff Dumpsters

Dumpster rentals are for 7 days. No dirt, rock, masonry, concrete, paint, tires, appliances or electronics will be accepted.

Please call/text Garbology at (720) 706-5544 when the container is full (to be hauled). If a container is kept longer than the rental period, customer will be charged $50/day. Anything over the weight limit is charged $50/ton (prorated for partial tons). Containers that are inaccessible, overfilled, or contain prohibited materials may warrant an additional $150+ charge.
